Construction Site Stormwater Runoff Control

To reduce the impact of construction site runoff on the waters of the Commonwealth by using BMPs, both structural and non-structural, to prevent construction site pollutants from negatively impacting other MS4s and streams.

A program must be developed, implemented, and enforced that reduces pollutants in stormwater runoff from construction activities that disturb one acre or greater of land or less than one acre if they are part of a larger common plan that disturbs one acre or more. The following elements must be included in the program:

• An ordinance or other regulatory mechanism that reduces pollutants in any stormwater runoff to the MS4 from construction activities (≥ 1 acre or part of a larger common plan). The ordinance shall include:
  • Requirements for construction site operators to implement ESC BMPs that are at least as protective as Kentucky’s General Permit for Stormwater Construction sites (KYR100000)
  • Requirements for construction site operators to control waste (i.e. – building materials, concrete truck washout, chemicals, litter, sanitary waste)
  • Requirements for demonstration that a NOI for coverage under the stormwater construction general permit has been submitted
  • Establishment of authority for site-plan review
  • Establishment of authority for receipt and consideration of public input
  • Establishment of authority for site inspections and enforcement of control measures
• A permitting process with plan review and enforcement capability
• Procedures for the inspection of all known permitted construction sites to verify proper installation and maintenance of required erosion and sediment controls. Enforcement shall be conducted based on the inspections.
• Development and implementation of an escalating enforcement strategy to respond to issues of noncompliance.
• Procedures to inventory projects and prioritize sites for inspection that include tracking inspection results and enforcement procedures taken.
• A training program for staff in the fundamentals of erosion prevention/sediment control and in plan review.
• Procedures for providing construction-site operators with educational and training measures or notifying them of available training opportunities.
• Tracking of activities to document compliance with the permit and for preparation of the annual report.

Activities that are part of the University’s Stormwater Quality Management Plan include:

• Improvement of the construction project notification and review process.
• Development of an alternative to permit issuance as part of the formal project review process.
• Strengthening contract language to require contractors to implement SWPPP controls, obtain permit coverage, and maintain compliance with stormwater requirements.
• Audits/inspections of construction sites on a monthly basis.
• Development of a progressive/escalating enforcement policy and procedures for SWPPP/KYR10 violations.
• Development and implementation of an internal QC process to ensure site inspections are being performed and KYR10 requirements are met.
• The review of construction plans to ensure SWPPP measures are being incorporated for all projects disturbing 1 acre or more.
• The continued adoption of LFUCG’s most recent stormwater requirements.
• Development of a contractor training program that addresses topics such as KYR10 and UK requirements.
